Shakespeare Company, LLC (“Company” or “We”) respect your privacy and are committed to protecting it through our compliance with this policy.  This policy describes the types of information we may collect from you or that you may provide when you visit the website http://shakespeare-ce.com/, any of its mobile apps, web-browser based device interfaces, web apps (collectively the “Site”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect on this Site, in email, text, and other electronic messages between you and this Site.

Information Gathered by Us
For visitors to this Site and registered users, we log standard technical, and demographic information, such as your IP address, Google Analytics reported interest, demographics and the kind of browser you are using. If you choose to register with us, you may be asked to provide personally identifiable information (“PII”), such as your name, postal address, telephone number and email address. Our product warranty registration pages may additionally collect information about the product you purchased from us. Information that may be collected include date of purchase, copy of your purchase receipt, device mac address and IMEI number. Some of our products may collect and send us performance and technical support data in the form of logs, IP address, IMEI number, SIM card number etc. Mobile apps used for the purpose of controlling our products do not access, use or share any of your personal information or PII although may need to access local memory, send and receive other data to and from the products that you purchased from us to perform its intended function. If a secure shopping Site is offered to you through a link on this Site, and you choose to shop there, we also may collect your financial information, such as your credit card number, along with billing, shipping and other transactional information. We may collect other PII when you provide feedback or comments online, such as: information about our products you own; information that you provide by filling in forms on our Site (This includes information provided at the time of registering to use our Site (if applicable), or posting material. We may also ask you for information when and if you enter a contest or promotion sponsored by us, and when you report a problem with our Site); records and copies of your correspondence (including email addresses), if you contact us; your responses to surveys that we might ask you to complete for research purposes; details of transactions you carry out through our Site and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Site; your search queries on the Site; you also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site, or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

We may use cookies or other technologies to administer this Site and provide a more tailored and user-friendly service to you. Pixel tags are tiny graphic files that are included in HTML-encoded email messages. We may use pixel tags to gather information about emails sent to our users. When such a message is opened in an HTML-capable email program, the recipient’s computer accesses our server to retrieve the pixel tag file, and allows us to record and store the date and time, the recipient’s email address, and other standard logging information. These pixel tags may also read cookies.

Our Use and Disclosure of Information
The information we collect about you in the course of our relationship is used to operate our Site and offer products and services to you. For example, we may use your PII to fulfill your order, to send you information about our company and services, or to contact you when necessary. We may also use your PII to send you periodic emails about new products and services or upcoming events (“promotional email”). If you opt-in to receive information from our selected partners through the “My Account” page, we may also share your PII with our unaffiliated third-party partners for marketing or other business purposes. Please refer to the section of this Policy titled “Opt Out,” below, if you would like to opt out of having your PII shared with affiliated or unaffiliated third parties for third-party direct marketing.

We reserve our right to share PII about our users with other third parties, including: (1) with your consent or as otherwise stated in this Privacy Policy; (2) when we have a good faith belief it is necessary pursuant to a subpoena or other judicial or administrative order; (3) where required by law; or (4) at our sole discretion, where we deem it necessary to respond to claims, to protect the safety of any individual or the public, or to protect our rights or property or the rights or property of any third party. In addition, we may share aggregated demographic and statistical information with third parties.

In the event of a change of ownership or corporate restructuring (i.e. a sale, merger, acquisition or transfer of our assets), we may share or transfer your PII to a third party.

Send to a Friend

If you email product information to a friend, you and your friend’s name and email addresses are required. This ensures that your friend will know you have requested that we send them an email. Any email address obtained for the “Send to a Friend” service will only be used for this purpose.

Surveys and Contests

At various times we may offer surveys or contests to users. Surveys may ask for contact information or unique identifying information to increase the value of the results. Contests may require contact information or other demographic or personally identifiable information in order to determine eligibility.  We use information collected from surveys and contests to improve our service and to notify and contact winners of various contests. From time to time, a contest may ask users to provide content, such as tips that make the most of their product, which may be provided to the public.

Third Party Websites

We do not control the information collection and distribution policies on Internet domains other than this Site. When you are on this Site, you may be directed to other sites that are beyond our control. For example, if you “click” on a link on this Site, the “click” may take you off of this Site. These other sites may independently collect data, solicit personal information, or send their own cookies to you. We are not responsible for any use of the information including click-stream data that you may create when using such third party sites.

Updating or Removing User Information

You may choose to correct or update the PII you have submitted to us online by emailing us at ConsumerAffairs@jardenmaterials.com. If you request to have your PII removed, we will remove it from our active database, though it may remain stored indefinitely in our back-up media and archival records.

Opt-Out

We do not disclose an individual customer’s PII to third parties for third-party direct marketing purposes if that individual has submitted a request not to have his or her PII shared for this purpose. If you would like to opt out of having your PII shared with third parties for third-party direct marketing purposes, you may submit your opt-out request by email at ConsumerAffairs@jardenmaterials.com or by U.S. mail at Shakespeare Company, LLC., Attn: Consumer Affairs- Shakespeare Electronics, 6111 Shakespeare Rd, Columbia, SC 29223. In addition, we also allow you to decide whether you want to receive promotional email from us. If you do not wish to receive promotional email messages from us, please submit your request by email at ConsumerAffairs@jardenmaterials.com.  Lastly, if you wish to opt-out of participating in any Google Analytics, you may do so by clicking on the following link, https://tools.google.com/dlpage/gaoptout/, and following the steps outlined by Google.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We have implemented security measures to protect against the loss, misuse and alteration of the PII under our control. Automatic Software Updates

From time to time we may develop patches, bug fixes, updates, upgrades and other modifications to improve the performance of our Mobile, Web-browser based device interfaces, Web Applications (“Apps”) and their affiliated services and/or products (collectively the “Updates”). These may be automatically or manually installed without providing any additional notice or receiving any additional user or owner consent. You consent to this automatic update. If you do not want such Updates, your remedy option is to terminate your account and stop using the Apps. If you do not terminate a previously created account, you may continue to receive Updates automatically. You acknowledge that you may be required to install Updates to use the Apps and you agree to promptly install any Updates provided.

Use by Minors Prohibited

Our Site is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Site or on or through any of its features/register on the Site, make any purchases (if applicable) through the Site, use any of the interactive or public comment features. if any, of this Site or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.
